MASSACHUSETTS  CRACKS      DOWN ON           CONTRACTORS

A little-noticed set of provisions in a law    overhauling public construction contracting in Massachusetts greatly reduces the ability of Massachusetts employers to use independent contractors. It also greatly increases the penalty     for misclassifying employees as independent  contractors.

The additional risk is especially high for state  contract holders and bidders who, in addition to   civil and criminal penalties, also face disbarment  from contracting with the state or any municipality.

The new law says an individual performing any service is an employee unless:

  1. The individual is free from control and direction in connection with the performance of the service both under his contract for the  performance of service and in fact; and
  2. The service is performed outside the usual course of the business of the employer; and
  3. The individual is customarily engaged in an independently established trade, occupation, profession or business of the same nature      as that involved in the service performed.

For reporting and paying unemployment compensation taxes, whoever fails to treat an individual as an employee faces criminal sanctions.

Any entity and the president and treasurer of a corporation and any officer or agent having the management of the corporation or entity is liable     for violations.

Since federal withholding rules are based on state law, this act will create liability under internal   revenue code rules for Massachusetts employers.

HOME-BASED BUSINESSES

Most people, at one time or another, dream about being their own boss or starting their own business. Home-based businesses are hotter than ever. The U.S. Small Business Administration (SBS) reports that 53% of all small businesses in America today are home-based businesses. In fact, over two-thirds of all sole proprietorships, partnerships, and S corporations are home-based.

Having achieved the dream, it's important to protect it. Many home-based business owners assume their Homeowners insurance policy will provide the coverage they need for both their home and business. That's not necessarily the case. Research by the Independent Insurance Agents & Brokers of America confirm that insureds understand very little about the need for insurance coverage. Some of the survey's key points were:

  • Nearly 60% of the nation's home-based businesses have no business insurance.
  • A significant percentage (87%)of the uninsured do not understand why they need coverage.
  • 39% of the uninsured said they thought they didn't need business insurance or that they had some type of coverage for their business.
  • 29% of the uninsured thought their business was too small or posed no risk.

Because your Homeowners and Business Insurance is one of your most valuable financial protection tools, you should carefully consider your needs in determining the type and amount of coverage you have. Understanding your policy, its coverage, limits, and exclusions, is part of good financial planning.

At MassOne Insurance Agency, Inc. your needs are thoroughly assessed and analyzed to ensure your coverage adequately prepares your family or business for any eventuality.
